Welcome to ArtPay. By accessing our website at https://artpay.in or using any ArtPay billing software products and services, you agree to be bound by these Terms & Conditions ("Terms"). Please read them carefully before using our platform.

1. Acceptance of Terms

By creating an account, launching our software, or submitting an inquiry form, you acknowledge that you have read, understood, and agree to comply with these Terms and our Privacy Policy. If you do not agree, you must not use our services.

2. Account Registration & Responsibilities

To access certain features of ArtPay Billing Software, you may be required to register a store account. You agree to:

• Provide accurate, current, and complete business information.
• Maintain the confidentiality of your account credentials and passwords.
• Promptly notify ArtPay of any unauthorized account access or security breach.
• Accept full responsibility for all activities conducted under your store account.

3. Software Usage & Prohibited Activities

ArtPay grants you a non-exclusive, non-transferable, limited license to access and use our software for legitimate retail and business billing operations. You agree NOT to:

• Reverse engineer, decompile, or disassemble any part of the software.
• Use the software for illegal, fraudulent, or deceptive commercial activities.
• Interfere with system performance, overload server infrastructure, or attempt unauthorized database access.
• Resell, sublicense, or distribute the software to third parties without prior written consent.

4. Subscriptions, Payments & Billing

Pricing for ArtPay plans is set forth on our website or detailed in a specific commercial agreement. Payment terms include:

• Subscription fees are billed in advance on an annual or agreed periodic cycle.
• Failure to pay renewal fees may result in temporary suspension of software counter access.
• All fees are exclusive of applicable taxes (GST), which will be calculated where applicable.

5. Intellectual Property Rights

All rights, title, and interest in and to the ArtPay platform, including source code, branding, logos, software designs, and documentation, remain the exclusive property of ArtPay and its licensors.

6. Service Availability & Limitation of Liability

While we strive to ensure maximum availability of our cloud servers, ArtPay services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, ArtPay shall not be liable for indirect, incidental, or consequential damages arising from service interruptions or loss of business data.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Dharmapuri / Tamil Nadu, India.
